Terms of Service

1. Who We Are

GetInlytics is a trade name of RCB Digital Solutions, a company registered in India. Our contact email is hello@getinlytics.com. References to "GetInlytics", "we", "us", or "our" throughout these Terms refer to RCB Digital Solutions.

2. Our Services

GetInlytics provides the following services, each subject to these Terms:

• Free audit tools: GA4 and GTM Gap Analysis, SEO Optimiser, Vibe Check (security scanner), and GTM Cookbook. These are available at no cost and require no account.
• TagSense: A tag monitoring and analytics health platform available via a subscription at app.getinlytics.com. TagSense includes a monitoring script clients install on their own websites and a reporting dashboard.
• Professional services: Analytics implementation, consulting, and related services offered under separate engagement agreements.

3. Acceptable Use

By using our services, you agree that you will not:

• Use our services for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or extract our scanning logic, algorithms, or proprietary methodologies.
• Use automated scripts, bots, or scraping tools to access our services at a volume beyond normal human use, without a written API agreement with us.
• Use scan results from our tools to build products or services that compete with GetInlytics.
• Attempt to probe, test, or exploit vulnerabilities in our infrastructure beyond what is inherent in normal use of our tools.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of our services.

4. TagSense Installation Terms

These terms apply to any person or entity ("Client") who installs the TagSense monitoring script on a website.

4.1 Authorisation and Ownership

• By installing TagSense on a website, you confirm that you are the owner of that website or have received explicit written authorisation from the owner to install third-party monitoring scripts.
• You will not install TagSense on websites that you do not own or control.
• You will not use TagSense to monitor competitor websites or any website for which you lack a legitimate monitoring purpose.

4.2 Privacy and Compliance Obligations

• You confirm that your website's privacy policy discloses the use of TagSense and describes, at a minimum, that a tag monitoring tool is in use and what categories of data it collects.
• You are responsible for obtaining any consent from your own users required by applicable law (including GDPR, DPDP Act, CCPA) before TagSense collects data on your website.
• You are responsible for configuring TagSense appropriately for the geographic regions where your users are located, including complying with regional consent requirements.
• GetInlytics will make its Data Processing Agreement (DPA) available to you on request. If your website serves users in the EU, UK, or India, you agree to execute the DPA before going live with TagSense. Email hello@getinlytics.com to request it.

4.3 Data Controller and Processor Roles

You are the Data Controller for all data collected by TagSense on your website. GetInlytics acts as a Data Processor, processing data only on your behalf and according to your instructions and these Terms. GetInlytics will not use data collected via TagSense on your website for any purpose other than providing the TagSense service to you.

4.4 Termination of Access

GetInlytics reserves the right to suspend or terminate your TagSense access without notice if you violate any of these installation terms, if your use creates legal or reputational risk for GetInlytics, or if you fail to execute the required DPA when requested.

5. TagSense Dashboard Terms (Paid Subscriptions)

These terms apply to paid subscription accounts for the TagSense dashboard at app.getinlytics.com.

5.1 Subscription Plans and Limits

• Free plan: 3 monitored tags, 1 site, limited dashboard data. No payment required.
• Starter plan: 10 monitored tags, 3 sites, all 9 dashboards, daily reports, real-time alerts.
• Pro plan: 50 monitored tags, 10 sites, advanced dashboards, AI referral detection, DPO compliance log, payment page security audit.
• Enterprise plan: Unlimited tags and sites, custom features, dedicated support. Pricing on application.
• Plan limits are enforced at the account level. Exceeding limits may result in data not being captured for tags or sites beyond the plan allowance.

5.2 Payment Terms

• Paid plans are billed monthly or annually. Annual plans are charged as a single upfront payment.
• Payment is processed via Razorpay in Indian Rupees (INR). USD prices shown on our website are for reference only.
• Subscriptions auto-renew unless cancelled before the renewal date.
• We will notify you by email at least 7 days before an annual renewal charge.

5.3 Cancellation and Refunds

• You may cancel your subscription at any time. Access continues until the end of your current billing period.
• We do not offer pro-rata refunds for partial billing periods, except where required by law or at our sole discretion.
• For annual subscriptions cancelled within 14 days of the start of a new annual term, we will issue a full refund upon request, provided you have not made more than 2 substantial uses of the paid features during that period.

5.4 Data Deletion on Account Closure

When your account is closed or your subscription expires without renewal, we will retain your account data for 30 days to allow you to recover it or export it. After 30 days, all account data including monitoring history, dashboard configurations, and workspace settings will be permanently deleted. Contact hello@getinlytics.com before the 30-day window to request a data export.

5.5 Service Availability

• Enterprise plans: We target 99.9% monthly uptime for monitoring script data ingestion. Scheduled maintenance windows are communicated at least 24 hours in advance.
• Starter and Pro plans: We make commercially reasonable efforts to maintain service availability but do not guarantee a specific uptime percentage.
• Free plan: Provided on a best-effort basis with no uptime commitment.
• Downtime caused by third-party services (including Google BigQuery, Supabase, or internet infrastructure) does not count against any uptime commitment.

5.6 No Liability for Third-Party Tag Failures

TagSense detects and reports on the behaviour of third-party tags installed on your website. We are not responsible for the failures, misfires, or incorrect behaviour of those tags. Our reporting is informational - it tells you what is happening, not why. Diagnosis and remediation of tag issues remain your responsibility or that of your analytics team.

6. Free Scanner Tool Terms

6.1 Permitted Use

Our free scanning tools (GA4 Gap Analysis, SEO Optimiser, Vibe Check) may only be used to scan:

• Websites that you own.
• Websites for which you have received explicit written permission from the owner to perform an audit.

You must not scan websites without the owner's permission. Doing so may violate the Computer Fraud and Abuse Act (US), the Computer Misuse Act (UK), the Information Technology Act (India), and equivalent laws in other jurisdictions.

6.2 Prohibited Use

• Automated or bulk scanning via scripts or programs is prohibited without a prior written API agreement with GetInlytics.
• Using our tools to benchmark or analyse competitor websites without competitor consent is prohibited.
• Using scan results to build tools or datasets that compete with GetInlytics is prohibited.

6.3 No Guarantee of Completeness

Our free tools provide a snapshot analysis based on a single server-side page load. They do not replace comprehensive manual audits performed by qualified professionals. Scan results may not capture behaviour behind authentication, multi-step user flows, or JavaScript-rendered content that requires user interaction.

7. Intellectual Property

All content on getinlytics.com - including text, code, tool interfaces, the GTM Cookbook recipes, and the TagSense monitoring script - is owned by or licensed to RCB Digital Solutions. You may use our tools and read our content for personal and business purposes consistent with these Terms. You may not reproduce, republish, sell, or redistribute our content, tools, or monitoring scripts without prior written permission.

The GTM Cookbook recipes are provided for your own implementation use. You may not package and distribute the recipes as a competing product or service.

8. Disclaimer of Warranties

9. Limitation of Liability

To the maximum extent permitted by applicable law, GetInlytics, RCB Digital Solutions, and their respective officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
• Loss of revenue, data, goodwill, or business opportunities arising from your use of or reliance on our services.
• Failures, errors, or inaccuracies in scan results produced by our free tools.
• Any damage arising from your reliance on our tools as a substitute for qualified professional advice.

Where liability cannot be excluded by law, our total liability for any claim arising out of or related to these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim. For free plan users, this means our total liability shall not exceed INR 1,000 (approximately USD 12).

10. Compliance Advice Disclaimer

Specifically:

• A "pass" result from our tools does not mean you are legally compliant with any regulation.
• A "fail" result is a flag for investigation, not a legal determination.
• We are not liable for any regulatory fines, enforcement actions, or legal costs arising from your reliance on our scan reports.
• Before making compliance decisions based on our outputs, we strongly recommend consulting a qualified privacy lawyer or data protection specialist.

11. Termination

We reserve the right to suspend or terminate your access to our services immediately and without notice if you breach these Terms, use our services fraudulently or in a way that could harm GetInlytics or other users, or if required to do so by law.

You may stop using our services at any time. Termination of these Terms does not affect accrued rights or liabilities.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email (to registered users) and by updating the "Last updated" date on this page. Continued use of our services after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

For EU users: nothing in these Terms limits your rights under applicable EU consumer protection law or your ability to bring claims before the courts of your habitual residence.
